On this page
These terms are between you and Dr Brittany Jane, trading as Avatara Institute (“we”, “us”). They cover this website, the Avatara community at www.avatara.community, our online programmes, and our membership. You agree to them when you create an account, join, or buy.
Nothing in these terms limits any right you have under the Australian Consumer Law or other law that cannot be excluded.
What is included, the dates, the access period and the price are shown on each programme page and at checkout. For a purchase, that information forms part of the agreement. In-person events are booked through an application and have their own terms and waiver.
Prices are in Australian dollars (AUD). [[OWNER TO CONFIRM: whether the business is registered for GST and whether displayed prices include it. State that here]]
Payment is taken by our payment provider, not by us. We do not see or store your full card number.
Membership. The Avatara membership renews automatically each month or year until you cancel. To cancel, [[OWNER TO CONFIRM: how a member cancels, for example in their Circle account or by emailing hello@. This must be something a member can actually do today]]. Cancelling stops the next renewal. Your access continues to the end of the period you have already paid for. We do not refund part of a period.
Payment plans. Some programmes can be paid in instalments. When you choose a plan, you agree to pay each instalment on its due date, and you authorise us and our payment provider to charge your card or account for it. A plan has an end date, and we will not charge beyond it. [[OWNER TO CONFIRM: what happens if an instalment fails: whether we retry, pause access, or charge a fee]]
If you stop partway through a payment plan, we keep what you have already paid, and [[OWNER TO CONFIRM: whether a person who stops partway still owes the remaining instalments. CONFLICT TO RESOLVE: the offers document dated 4 October 2026 says she keeps what was paid and the person is not held to the rest (for example paid A$2,000 of A$3,000 owes nothing more). Her 2023 terms said the full contract amount stays payable if she ends access for misconduct. This draft follows the 2026 offers document: no further instalments are charged. Confirm, and say what applies if access is ended for misconduct]]. Joining a programme late is fine as long as you are on a plan.
We may change prices for new purchases at any time. [[OWNER TO CONFIRM: how much notice a member gets before their own membership price changes, and whether grandfathered rates carry over]]
We set aside content, places and live time for you, so we do not give refunds if you change your mind, stop taking part, or cannot attend. If we cancel a programme or an event, we will refund what you have paid for it. [[OWNER TO CONFIRM: whether transfers or credits are ever offered instead of a refund. Her 2023 terms allowed a transfer or credit for in-person events and online mentoring with notice, but the 2026 offers document says only no refunds unless she cancels]]
This does not affect your rights under the Australian Consumer Law. If a service we supply has a major problem, you may be entitled to a refund or other remedy, and consumer guarantees apply that cannot be excluded. If you think this applies, write to [email protected].
All the lessons, videos, audio, recordings, workbooks, practices, written material, names and logos on the website and in the community belong to Dr Brittany Jane or Avatara Institute, or to others who have licensed them to us. When you buy or join, you get a personal, non-transferable licence to use them for yourself, for the access period you paid for. You agree not to:
Access ends when your membership or access period ends. We may end it earlier under section 8.
You keep ownership of what you post in the community. You give us permission to host it and show it to other members there. [[OWNER TO CONFIRM: whether she wants any wider right to use members' posts or stories, for example as testimonials. This draft assumes she will always ask first]]
Our live calls are held on Zoom and are recorded. [[OWNER TO CONFIRM: whether any live sessions are held inside Circle rather than Zoom, and update this line if so]] A recording can include your voice, your image if your camera is on, your name as shown on screen, and what you type in chat.
By joining a call you agree that we may store the recording, make it available as a replay to members and participants, and sell or licence it as part of programmes, memberships or other products. You can keep your camera off, use a first name only, and choose not to speak. You must not make your own recording of any call.
[[OWNER TO CONFIRM: whether people on calls can ask to be edited out of a recording that is sold, and what she can really do. The privacy policy currently leaves this as a placeholder too. Keep the two pages consistent]] Our Privacy Policy explains how recordings and other personal information are handled.
If you break these terms, are disruptive, or put the group or the facilitators at risk, we may remove content, suspend your access, or end it, without a refund. [[OWNER TO CONFIRM: what happens to remaining payment-plan instalments if she ends someone's access for misconduct. See the payment plan note in section 4]]
Our programmes and community are personal development, education and embodied practice. They are not therapy, counselling, psychological treatment or medical care, and Dr Brittany Jane is not acting as your therapist, psychologist, counsellor or doctor. Her doctorate is an academic qualification. [[OWNER TO CONFIRM: an accurate description of her qualifications and any professional memberships or registrations (for example IICT), checked by a lawyer. Use of the title Dr alongside health-related practice should be reviewed so nobody could mistake it for a medical title]]
If you are in crisis or in danger, contact emergency services (000 in Australia). In Australia you can also call Lifeline on 13 11 14. If you are elsewhere, contact your local emergency service.
Some programmes need you to complete a separate participant agreement and waiver before you start. It is a separate agreement. It adds to these terms and does not replace them. If the two disagree about the programme you are joining, [[OWNER TO CONFIRM: which document wins when the waiver and these terms conflict, for the programme concerned]]. Health information you give in a waiver is handled under our Privacy Policy.
We will provide our services with due care and skill. To the extent the law allows:
Nothing in these terms excludes liability that cannot be excluded by law, including under the Australian Consumer Law.
The information on this website is general and is not advice. We try to keep it accurate and available, but we do not promise it will always be error-free or online. Links to other websites are for your convenience and we are not responsible for what is on them. You must not copy the website or collect its content by automated means.
How we collect and use your personal information is explained in our Privacy Policy.
We may update these terms. The new version will be posted on this page with a new date. A change does not alter what you have already bought: the terms that applied when you bought continue to apply to that purchase unless you agree otherwise. [[OWNER TO CONFIRM: whether she wants a different rule for ongoing memberships, and how members are told of a change, for example by email]]
These terms are governed by the law of [[OWNER TO CONFIRM: the Australian state or territory whose law applies, for example New South Wales if the business is based there]], Australia, and the courts of that place can decide any dispute. If you live outside Australia, you may also have consumer rights under your own local law that we cannot exclude. If something goes wrong, please write to us first at [email protected] and we will try to sort it out.
